TUESDAY, 15 October 2024 Official Gazette Issue: 32693 REGULATION From the Ministry of Environment, Urbanization and Climate Change (Presidency of Climate Change): REGULATION ON FLUORINATED GREENHOUSE GASES SECTION ONE Preliminary Provisions Purpose ARTICLE 1- (1) The purpose of this Regulation is to regulate the principles and procedures regarding the management of fluorinated greenhouse gases and other fluorinated substances in order to control the emission of fluorinated greenhouse gases within the scope of the Montreal Protocol on Substances that Deplete the Ozone Layer, to which our country is a party. Scope ARTICLE 2- (1) This Regulation; a) It covers the principles regarding the labeling, data collection, leakage controls, reporting, market placing, import, export and use, quota distribution, recovery, recycling, reclamation and destruction of fluorinated greenhouse gases and other fluorinated substances, including those in products and equipment, b) It covers the issues and regulations regarding the training and certification of real and legal persons who intervene in equipment that contains fluorinated greenhouse gases or whose operation relies on these gases. (2) This Regulation does not cover the recovery of fluorinated greenhouse gases emitted from air-conditioning equipment in motor vehicles. Basis ARTICLE 3 - (1) This Regulation; It has been prepared based on Articles 3 and 20 of the Environmental Law No. 2872 dated 9/8/1983, Article 97 of the Presidential Decree No. 1 on the Organization of the Presidency, Article 792/D of the Presidential Decree No. 4 on the Organization of Affiliated, Related, Associated Institutions and Organizations and Other Institutions and Organizations under Ministries, the United Nations Framework Convention on Climate Change, which was approved for ratification by Law No. 4990 dated 16/10/2003, and the Amendment to the Montreal Protocol Agreed on at the Twenty-Eighth Meeting of the Parties (Kigali Amendment 2016), which was approved for ratification by Law No. 7295 dated 4/3/2021. Compliance with European Union legislation ARTICLE 4- (1) This Regulation has been prepared within the framework of compliance with European Union legislation, taking into account the Regulations (EU) No. 517/2014 dated 16/4/2014 and (EU) 2024/573 dated 7/2/2024 of the European Parliament and of the Council on Fluorinated Greenhouse Gases. TUESDAY, 15 October 2024 Official Gazette Number: 32693 REGULATION Definitions ARTICLE 5- (1) In this Regulation; a) Military component: The central and provincial organization of the Ministry of National Defense, the General Staff, the Land Forces Command, the Naval Forces Command, the Air Forces Command, the National Defense University and the institution, detachment, headquarters or facility of the General Directorate of Mapping, b) Ministry: The Ministry of Environment, Urbanization and Climate Change, c) Maintenance or technical service: All activities including the separation of circuits that transfer fluorinated greenhouse gases to the system, removal or reassembly of circuits or equipment parts and repair of leaks, excluding recovery and leakage controls, ç) Presidency: The Presidency of Climate Change, d) Multiple central cooling systems: Systems with two or more compressors operating in parallel and connected to one or more common condensers and a series of cooling devices such as refrigerator display cases, refrigerator cabinets, freezers or refrigerated storage rooms, e) Distributor: A real or legal person operating in Turkey that distributes fluorinated greenhouse gases or other fluorinated substances domestically, f) Decommissioning: Any equipment or equipment containing fluorinated greenhouse gases. g) Other fluorinated substances: Substances listed in ANNEX-2 or mixtures containing at least one of these substances, ğ) Bulk gas: Hydrofluorocarbons carried in packaging such as tubes, tanks, isotanks, excluding those in equipment, h) Equipment Operators Central Database (EKOMVET): Electronic database containing the logbooks of the equipment specified in the first paragraph of Article 7, ı) Electrical switchgear: Switching, measuring, protection and electrical energy conversion devices intended to be used in connection with the generation, transmission, distribution and conversion of electrical energy and combinations of these tools and equipment with interconnections, fittings and supporting structures, i) The amount of fluorinated greenhouse gases in electrical switchgear: The amount of fluorinated greenhouse gases in a single compartment or in any other part separated from other parts of electrical switchgear, j) Activity Reports Database (FARAVET): Importing, exporting or operating fluorinated greenhouse gases or other fluorinated substances in products or equipment or in bulk. k) Fluorinated greenhouse gases: Hydrofluorocarbons, perfluorocarbons, sulfur hexafluoride or mixtures containing at least one of these substances or other greenhouse gases containing fluorine, listed in ANNEX-1, l) Recycling: Recycled
